The certificates must also include the patient’s signature and/or thumb mark, address, and at least one identification mark.

Additionally, medical certificates are utilized to confirm an individual’s health status, ensuring they are free from contagious diseases, drug addiction, mental illness, or other health issues. These certificates are also necessary for obtaining a driver’s license.
For those seeking disability benefits, a medical certificate of fitness may be crucial for resuming duties or securing eligibility for specific jobs. In matrimonial matters, a medical certificate indicating the presence of mental illness at the time of marriage can be grounds for annulment or divorce. Moreover, medical certificates play a role in child custody cases and may be presented as part of the insanity defense in criminal responsibility cases within a court of law.
Professional Authority of Mental health Professionals
Psychologists, being professionals in mental health, undergo training to evaluate and diagnose psychological conditions. Although their expertise is crucial within the mental health domain, the legal validity of their medical certificates can be subject to variations. Psychiatrists and mental health professionals are frequently called upon to issue certificates related to admission, treatment, fitness, competence, administration, legal proceedings, and welfare measures for individuals with mental illnesses. The role of psychiatrists and mental health professionals in providing certificates has become even more significant with the implementation of the Mental Healthcare Act, 2017 (MHCA 2017). The issuance of certificates poses a challenge in maintaining patient confidentiality, especially considering the involvement of multiple stakeholders such as Central and State Mental Health Authorities, Mental Health Review Board, mental health professionals, including psychiatrists, and caregivers in psychiatric patient care. There is a scarcity of training at the undergraduate or postgraduate level regarding documentary practices and certification in this field.

The validity of medical certificates issued by psychologists hinges on the specific laws and regulations that govern the practice of psychology within a given jurisdiction. In certain areas, psychologists may possess the authority to issue medical certificates pertaining to mental health conditions.
The Medical Council of India has granted medical practitioners the right to issue certificates, with psychiatrists in both government and private sectors, as well as medical officers, being authorized to issue certificates in mental healthcare. The Mental Healthcare Act, 2017 (MHCA 2017), extends this privilege to clinical psychologists, psychiatric social workers, and psychiatric nurses, in addition to medical officers and psychiatrists, allowing them to issue reports and certificates in various clinical scenarios.

If it is established that a person with mental illness lacks the capacity to consent and poses a risk to self, others, or property, and is unable to self-care due to mental illness, supported admission may be initiated. Under section 89, a capacity assessment for admission consent requires an independent evaluation by one psychiatrist and one Mental Health Professional (MHP). For continued admission beyond 30 days, section 90 mandates a reassessment by two independent psychiatrists to determine the ongoing need for admission and capacity to consent.

The certificate should encompass details such as the date of appointment, the patient’s condition, the anticipated date of return to work, and must be addressed to the intended recipient. If multiple copies are required, they should be explicitly marked as duplicates.
Moreover, the certificate must bear the doctor’s letterhead, including complete address and qualifications, or if not, the doctor’s full details should be mentioned. Critical elements such as the date, time, and place of issue are imperative in the medical certificate. Issuance should be confined to legitimate and essential purposes, always reflecting truth, clarity, and unambiguous language. The disclosure of a diagnosis without the patient’s express consent is a breach of confidentiality, unless mandated by law. Furthermore, considering the patient’s right to confidentiality and consent is paramount. Importantly, a medical certificate can be issued post-sick leave, with due consideration given to the patient’s ability to resume work, even if with altered duties.
The responsibilities of a registered medical practitioner extend to maintaining a comprehensive register of medical certificates, capturing all necessary details. When issuing a certificate, the doctor must consistently record patient identification marks and retain a copy of the certificate. Additionally, the physician is obligated to display their registration number from the State Medical Council or Medical Council of India in all patient certificates. Understanding the age criteria for medical certification is crucial. The minimum age for certification is one completed year. Children above one year and up to the age of 5 years receive a diagnosis of Global Developmental Delay (GDD). For those above 5 years, a diagnosis and certificate of Intellectual Disability are provided.
- Validity of Certificate:
The validity of the certificate varies based on age. For children under 5 years, the certificate is temporary, valid for a maximum of 3 years or until the child reaches 5 years of age, whichever comes earlier. For children over 5 years, the certificate mentions a renewal age. Renewal is required at the ages of 5, 10, and 18. The certificate issued at 18 years is valid for a lifetime.

Understanding one’s rights concerning medical certification is essential. A person has the right to request certificates from their treating practitioners.
